Terms and Conditions
1. Definitions

1.1 Australian Consumer Law means Schedule 2 to the Competition and Consumer Act 2010 (Cth).

1.2 Booking Confirmation means the email, receipt or other written confirmation issued by us via our
website, by email or an authorised booking platform.

1.3 Participant means each person who attends or is booked to attend a Workshop, including a
purchaser where that person also attends.

1.4 Price means the price and any disclosed booking or payment fee payable for the Workshop.

1.5 Provider, we, us or our means Get Handy Workshops and Training Pty Ltd trading as DIY
Renovation School (ABN 63 660 566 405).

1.6 Workshop means the in-person practical training, class, course, program or related session identified
in the Booking Confirmation, including any classroom, demonstration, online, off-site or practical
component.

1.7 Website means our website and any booking platform through which a Workshop is advertised or
booked.

1.8 you or your means the purchaser and, where applicable, each Participant. A purchaser who books
for another Participant must ensure that Participant receives and accepts these Terms before
attending.

1.9 Administration Fee means the administration fee set out in the Provider details above, as applied to
your booking and any Booking Confirmation.

2. Bookings and acceptance

2.1 A booking is an offer to purchase a place in the Workshop. It is accepted when we issue the Booking
Confirmation and receive cleared payment or approve an instalment arrangement.

2.2 Places may be limited and are allocated on a first-confirmed basis. We may reasonably decline or
cancel a booking for capacity, eligibility, safety, security, legal, insurance or operational reasons. If we
cancel under this clause for reasons not caused by you, we will provide the remedy required by
clause 12.

2.3 You must provide complete and accurate booking information, including the Participant’s correct
name, age where relevant, contact details, emergency contact and any information reasonably
requested for safety or accessibility.

2.4 Where a Workshop has a prerequisite, such as a minimum age, a fitness or health requirement, or
completion of another Workshop or course before the Participant may attend (for example, completing
a one-day Workshop before enrolling in a multi-day Workshop), the prerequisite is set out on the
booking page or in the Booking Confirmation and the Participant must satisfy it before the Workshop
starts. We may request reasonable evidence that a prerequisite has been met. If it has not, we may
decline the booking, refuse participation in the affected activities, or offer to transfer the Participant to
a Workshop for which they are eligible or provide a credit in accordance with clause 11. Nothing in
this clause limits any non-excludable right the Participant has under the Australian Consumer Law.

2.5 A booking is personal to the Participant and may only be transferred in accordance with clause 11.

3. Price and payment

3.1 You must pay the Price in accordance with your Booking Confirmation. Prices are stated in Australian
dollars and include GST unless clearly stated otherwise.

3.2 Third-party booking, card or payment-processing fees may apply.

3.3 If we offer payment by instalments, each instalment must be paid by its due date. If an amount
remains unpaid for more than 5 business days after written notice, we may suspend access or cancel
the booking. Any amount retained must be a reasonable estimate of our costs or loss and remains
subject to the Australian Consumer Law.

3.4 We may change prices for future bookings. A price change will not apply to an accepted booking
unless there is an obvious error or the change is required by law and we give you the options required
by law.

3.5 You must not initiate an unjustified chargeback. This does not restrict any lawful right to dispute a
transaction or seek a remedy.

4. Workshop scope and learning outcomes

4.1 The Workshop is practical education for personal skill development. The content, tools, projects and
learning outcomes are those described on the booking page or in the Booking Confirmation.

4.2 Unless expressly stated in writing, the Workshop is not nationally recognised training, does not confer
a licence, trade qualification, competency certification or authority to perform regulated work, and is
not a substitute for engaging a licensed or suitably qualified tradesperson.

4.3 Learning outcomes depend on factors including attendance, prior experience, physical capacity,
engagement and practice. We do not guarantee that a Participant will complete a project, achieve a
particular level of competence, obtain work, save a particular amount, or be able to safely undertake
every task independently after the Workshop.

4.4 Participants must comply with applicable laws, manufacturer instructions, building requirements and
licensing rules when later applying skills. Electrical, plumbing, gas, asbestos, structural, waterproofing
and other licensed or specialist work must only be performed by appropriately licensed or competent
persons where required.

4.5 Any example measurements, specifications or techniques are educational and may not be suitable for
a particular property, site, structure, material or project.

5. Participant eligibility, fitness and disclosures

5.1 The Participant must satisfy the age, prerequisite and other eligibility requirements stated for the
Workshop.

5.2 Practical workshops may involve standing for extended periods, lifting or handling materials, repetitive
movement, noise, dust, vibration, hand tools, power tools, ladders or work at low height, sharp edges,
adhesives, sealants, timber, masonry or other materials.

5.3 Before attendance, the Participant must disclose any injury, disability, allergy, medical condition,
pregnancy, medication, sensory issue or other circumstance that may reasonably affect safe
participation or require an adjustment. Disclosure is used only to assess safety and reasonable
adjustments and does not guarantee that every activity can be modified.

5.4 A Participant must not attend or participate while affected by alcohol, illicit drugs, medication that
impairs safe operation, acute illness, extreme fatigue or any condition that makes participation unsafe.

5.5 If unsure about fitness to participate, the Participant should obtain medical advice. We may require
reasonable medical clearance for a particular activity where safety reasonably requires it.

5.6 We may modify, restrict or stop a Participant’s involvement in an activity if we reasonably consider
participation unsafe. We will, where reasonably practicable, offer an alternative observation or
learning activity.

6. Minors and supervised participants

6.1 A person under 18 may attend only if the Workshop is expressly offered to their age group and the
required parent or guardian consent has been completed and if the parent or guardian stays to
supervise.

6.2 A parent or guardian who books for a minor warrants that they have authority to do so, has disclosed
relevant safety information and consents to reasonable first aid and emergency treatment if they
cannot be contacted.

6.3 Certain tools, machinery, materials or activities may be unavailable to minors or may require direct
one-to-one supervision. The trainer’s safety decision is final.

6.4 Photography and recording consent for a minor must be separately obtained from the parent or
guardian and must not be inferred solely from acceptance of these Terms.

7. Safety, PPE and workshop directions

7.1 The Participant must attend the safety induction, follow trainer instructions, signs, exclusion zones,
venue rules and safe operating procedures, and use guards, clamps, extraction and other controls as
directed.

7.2 The Participant must wear enclosed, sturdy footwear and suitable fitted clothing. Long hair must be
tied back and loose clothing, jewellery or accessories removed where they may create a hazard.

7.3 The Participant must wear all required personal protective equipment, which may include safety
glasses, hearing protection, gloves, dust masks or respirators.

7.4 A Participant must not operate any tool or equipment until authorised by a trainer and must not
bypass a guard, use damaged equipment, distract another person operating equipment, or use a tool
for an unauthorised purpose.

7.5 The Participant must immediately report hazards, defects, incidents, injuries, near misses and
uncertainty about a task.

7.6 We may remove a Participant from an activity or the Workshop if they fail to follow safety directions,
act recklessly, harass others, damage property or otherwise create a material risk. Except where
required by law, no refund is payable where removal results from the Participant’s serious or repeated
breach.
7.7 Participants must not bring their own tools, equipment, chemicals or materials unless we have
approved them in writing before the Workshop. Any approved item must be safe, maintained and
used only as directed.

8. Assumption of inherent risks and emergency response

8.1 You acknowledge that, even with reasonable care and supervision, practical tool-based training
involves inherent risks including cuts, splinters, bruising, strains, impact injury, noise exposure, dust
exposure, eye injury, allergic reaction and damage to clothing or personal property.

8.2 You voluntarily accept the ordinary and obvious risks inherent in participating, but this clause does not
exclude or reduce liability that cannot lawfully be excluded, including liability arising from our
negligence where the law does not permit exclusion.

8.3 In an emergency, we may provide first aid, contact emergency services and use the emergency
contact provided. You are responsible for ambulance or medical costs unless the law requires
otherwise.

9. Tools, materials, projects and participant property

9.1 Tools and materials supplied remain our property unless expressly identified as a take-home item.
Participants must use them carefully and return shared items as directed.

9.2 Materials may vary from images or examples due to availability, safety or suitability. Reasonable
substitutions may be made without changing the essential nature of the Workshop.

9.3 Handmade workshop projects are learning exercises and may contain cosmetic imperfections or
variations. They are not certified, engineered or warranted for structural, load-bearing, child-safety,
food-contact or commercial use unless expressly stated.

9.4 Before taking a project home, the Participant must follow instructions about curing, drying, finishing,
transport, installation, weight limits, maintenance and disposal.

9.5 You are responsible for personal property brought to the venue. We are not liable for loss or damage
except to the extent caused by our negligence, breach or other liability that cannot be excluded.

9.6 If a Participant deliberately or negligently damages equipment, venue property or another person’s
property, we may seek the reasonable repair or replacement cost, subject to applicable law.

10. Conduct, inclusion and venue rules

10.1 Participants must behave respectfully and must not bully, harass, discriminate against, threaten,
intimidate or endanger trainers, staff, venue personnel or other Participants.

10.2 Participants must respect personal boundaries, privacy and confidential personal information shared
by others.

10.3 Smoking, vaping, alcohol and illicit drugs are prohibited in workshop areas and otherwise subject to
venue rules.

10.4 We may refuse entry or require a Participant to leave for serious or repeated misconduct, unsafe
behaviour, material disruption or breach of venue rules. We will act reasonably and proportionately.

10.5 Support persons are permitted where agreed in advance and subject to capacity, safety and any
reasonable fee or requirement stated by us.

11. Participant cancellation, transfers and illness

11.1 Cancellation requests must be made in writing to the contact email in the Provider details above.

11.2 Subject to the Australian Consumer Law, if we receive cancellation at least the Participant
cancellation notice period before commencement, we will provide the option to transfer your workshop
and provide credit to you for that workshop, less the disclosed Administration Fee, which must reflect
our reasonable administration costs.

11.3 If notice is received after that period, the booking is non-refundable unless required by law. At our
discretion, we may offer a transfer or credit where we can refill the place or exceptional circumstances
apply.

11.4 A request to transfer to another date or substitute another eligible Participant is subject to availability,
prerequisite checks, notice, and the Administration Fee. A substituted Participant must accept these
Terms.

11.5 If a Participant cannot attend due to illness or a transmissible condition, they must notify us promptly
and must not attend if doing so would create an unreasonable risk. We may request reasonable
evidence and may offer the illness credit described in the Booking Confirmation.

11.6 No refund is payable merely because a Participant arrives late, leaves early, changes their mind, fails
to attend, does not complete a project or is excluded for their breach, subject always to non-
excludable rights.

11.7 Any credit is personal, not redeemable for cash, subject to availability, and expires at the end of the
credit-validity period unless law requires otherwise.

12. Cancellation, rescheduling and changes by us

12.1 We may cancel, postpone, relocate or reschedule a Workshop because of insufficient enrolments,
trainer unavailability, venue issues, equipment failure, safety concerns, extreme weather, government
direction, public health concerns or an event beyond our reasonable control.

12.2 We will use reasonable efforts to notify you using the contact details supplied. You must ensure those
details remain current.

12.3 If we cancel and do not offer a reasonable replacement, you may choose a refund of the Price or a
credit. If we reschedule or relocate and the change is not reasonably suitable, you may request a
refund within 7 days after notice.

12.4 We may make reasonable changes to trainers, timetable, sequence, examples, tools, materials or
activities where the overall nature and value of the Workshop are not materially reduced.

12.5 We are not responsible for travel, accommodation, childcare, lost income or other consequential costs
arising from cancellation or change except to the extent required by law. Participants should consider
refundable arrangements and appropriate insurance.

12.6 Nothing in this clause limits rights where a service is not supplied within a reasonable time or
otherwise fails a consumer guarantee.

13. Force majeure

13.1 A Force Majeure Event is an event beyond a party’s reasonable control, including natural disaster,
fire, flood, severe weather, epidemic, pandemic, government restriction, civil disturbance, transport
disruption, widespread utility failure, venue closure, supply failure or industrial action not caused by
that party.

13.2 A party is not liable for delay or failure caused by a Force Majeure Event, except for accrued payment
obligations and obligations that can reasonably continue.

13.3 We will take reasonable steps to minimise disruption and provide the options in clause 12.3 where the
Workshop cannot proceed.

14. Photography, video and recordings

14.1 We may photograph or record the Workshop for safety, training, recordkeeping or promotional
purposes only where appropriate notice and consent have been obtained.

14.2 We will not use a Participant’s name, image or voice for promotional purposes where they have
declined consent, and consent may be withdrawn for future use by written notice where reasonably
practicable.

14.3 Participants must not photograph or record another person without consent and must not record
safety demonstrations or course content where prohibited by the trainer.

14.4 Any permitted personal photographs or recordings must not be used commercially, misleadingly or in
a manner that infringes privacy, confidentiality or intellectual property rights.

15. Intellectual property

15.1 We or our licensors own all intellectual property in the Workshop content, manuals, plans,
worksheets, videos, demonstrations, branding and resources.

15.2 On full payment, we grant the Participant a limited, non-exclusive, non-transferable licence to use
supplied materials for personal learning and personal DIY projects.

15.3 Unless we consent in writing, you must not copy, record, reproduce, publish, sell, licence, share,
upload, teach, adapt or commercially exploit the Workshop or its materials, or remove ownership
notices.

15.4 The Participant retains ownership of original ideas or material they bring to the Workshop, but grants
us a limited licence to use it only as reasonably required to deliver the Workshop.

15.5 This clause does not prevent a Participant from discussing their own experience or using general
skills and know-how learned, provided they do not reproduce protected materials or disclose another
person’s confidential information.

16. Privacy

16.1 We collect, use and disclose personal information to administer bookings, deliver the Workshop,
manage safety, process payments, communicate with Participants and comply with law.

16.2 We may disclose information to trainers, venues, booking and payment providers, IT providers,
emergency services and professional advisers where reasonably required.

16.3 Health and accessibility information will be handled sensitively and shared only with people who need
it for safety, adjustment or emergency purposes.

16.4 Our Privacy Policy available on the Website applies. Marketing communications are sent only in
accordance with applicable law and may be unsubscribed from at any time.

17. Accessibility and reasonable adjustments

17.1 Please contact us as early as possible to discuss accessibility needs or reasonable adjustments.

17.2 We will consider reasonable adjustments in good faith, having regard to the Participant’s needs, the
inherent requirements of the activity, venue constraints, safety, cost and impact on others.

17.3 Where a particular practical activity cannot safely be adjusted, we may offer observation, a modified
task, alternative equipment, another Workshop or another reasonable option.

18. Consumer guarantees and liability

18.1 Nothing in these Terms excludes, restricts or modifies a consumer guarantee, statutory guarantee,
right or remedy that cannot lawfully be excluded, restricted or modified.

18.2 Our services come with guarantees under the Australian Consumer Law that cannot be excluded. For
a major failure with a service, you may be entitled to cancel and obtain a refund for the unused portion
or compensation for reduced value, and compensation for reasonably foreseeable loss or damage.
For a non-major failure, we are entitled to remedy the failure within a reasonable time.

18.3 To the maximum extent permitted by law, we are not liable for loss caused by your failure to follow
instructions, undisclosed conditions, unauthorised tool use, later application of skills outside the
Workshop, normal project variation, or events beyond our reasonable control.

18.4 Where liability may lawfully be limited, our liability for failure to comply with a guarantee in relation to
services is limited, at our option, to supplying the services again or paying the cost of having them
supplied again.

18.5 Any exclusion or limitation in these Terms applies only to the extent permitted by law and does not
apply to our fraud, wilful misconduct or liability that cannot be excluded.

19. Complaints and dispute resolution

19.1 Please raise any safety concern immediately with the trainer. Other complaints should be sent in
writing to the contact email with relevant details and the outcome sought.

19.2 We will acknowledge and investigate a complaint within a reasonable time and the parties will attempt
to resolve it in good faith.

19.3 If unresolved, either party may propose mediation through an agreed mediator or an appropriate state
or territory small business or consumer dispute service before commencing court proceedings, except
for urgent relief or where this step would prejudice a legal right.

19.4 Nothing in this clause prevents a person from contacting a consumer protection regulator or
exercising a statutory right.

20. Notices

20.1 A notice under these Terms must be in writing and sent to the email address supplied by the recipient
or stated in the Provider details above.

20.2 An email is taken to be received when it becomes capable of being retrieved at the recipient’s email
address, unless the sender receives an automated failure notice. A notice received after 5.00 pm or
on a non-business day at the recipient’s location is taken to be received on the next business day.

21. General
21.1 Entire agreement: The documents identified under “How these Terms apply” contain the entire
agreement about the Workshop, except for rights implied by law.

21.2 Variation: We may update these Terms for future bookings. Changes will not materially disadvantage
an existing accepted booking unless required by law or reasonably necessary for safety, security or
operation, and we give reasonable notice.

21.3 Assignment: You may not assign your rights without our consent. We may assign the agreement as
part of a genuine business restructure or sale, provided this does not materially reduce your rights.

21.4 Severance: An invalid or unenforceable provision is read down to the minimum extent necessary and,
if it cannot be read down, is severed without affecting the remainder.

21.5 No waiver: A failure or delay in exercising a right is not a waiver.

21.6 Governing law: These Terms are governed by the law of New South Wales, and the parties submit to
the courts of that jurisdiction and courts entitled to hear appeals, subject to any applicable consumer
forum rights.

21.7 Electronic acceptance: Booking, ticking an acceptance box, paying the Price or attending after
receiving these Terms constitutes electronic acceptance.
